All orders for goods accepted by Hand Crafted Cake are accepted subject to the following conditions that shall form part of and govern the contract of sale.

Acceptance of goods shall be deemed to be acceptance of these conditions of sale.

No agent or representative of Hand Crafted Cake has the authority to vary these conditions unless endorsed in writing by a Director of the company.

Please note: All orders for products or services will be acknowledged but confirmation of the price shall at all times be when the order is accepted by Hand Crafted Cake and such orders shall be shipped at the prices shown on the order acceptance which shall normally be the price or cost as shown on our Web Site on the date of the order. Up to date prices can be found on our Web Site which is continuously updated.

Terms: Orders are shipped with any delivery costs shown where appropriate.

1. Payment, Delivery and Price

A) Payment is to be made via credit or debit card or other method shown as acceptable on this Web Site and no other methods of payment are acceptable unless otherwise agreed in writing Hand Crafted Cake and no goods shall be dispatched until payment has been made to and accepted by Hand Crafted Cake’s. Credit card companies may require address verification (your credit card billing address) or other security information on website transactions. Any incorrect information given may result in a delayed or cancelled order for which Hand Crafted Cake accepts no responsibility.

B) Hand Crafted Cake shall dispatch goods to the purchaser on the chosen date for delivery provided that all monies due have been received or shall notify the purchaser if goods are unavailable or if there is any delay which may result in goods being delivered outside this period. In the event of a delay being more than 28 days Hand Crafted Cake shall offer the purchaser the right to cancel the order and shall make immediate refund to the purchaser of monies paid if the order is cancelled by the purchaser resulting from the delay.

C) In the event that any goods are unavailable, Hand Crafted Cake shall make a refund (or product substitution) to the purchaser of monies paid or notify the purchaser if only part of an order can be fulfilled and offer the purchaser the opportunity to accept part of the order. If the purchaser accepts part of the order Hand Crafted Cake shall make refund to the purchaser of monies paid relating to the unavailable goods only. In the event that a product is unavailable, Hand Crafted Cake will make a product substitution to a higher/equal product value.

D) Our policy requires 100% prepayment in advance for any orders made from this web site. Such payments are not refundable once the merchandise is ordered except as shown in these terms.

2. Liability A) Liability for any claim for damage by the purchaser shall diminish with delay in notification to Hand Crafted Cake and the purchaser should notify Hand Crafted Cake of any damage to goods within one day of delivery. This period may be extended at the sole discretion of Hand Crafted Cake.

B) In the event that goods differ in quantity or description from those ordered the purchaser shall notify Hand Crafted Cake in writing immediately and failure to do so could diminish the liability of Hand Crafted Cake.

3. Returned Goods A) The purchaser shall unless otherwise stated be responsible for the cost of return of all goods to Hand Crafted Cake and the returned goods shall be at the risk of the purchaser until actual receipt of the goods by Hand Crafted Cake. The onus of proof of safe delivery shall rest with the purchaser.

B) No credit shall be allowed for goods until they have been received complete.

C) A full credit including carriage costs shall be given by Hand Crafted Cake to the purchaser in the event that goods are faulty or damaged at the time of delivery and notice of fault or damage is given by the purchaser to Hand Crafted Cake immediately upon receipt.

D) Refused Shipments: Shipments returned marked refused will not result in refund and refusal of a shipment does not relieve the purchaser’s liability for paying any carriage charges incurred in the return of the goods to Hand Crafted Cake.

4. Consequential Loss The extent of Hand Crafted Cake’s liability to the purchaser for any default or breach whatsoever and howsoever arising shall in no case exceed the invoice value of the goods and Hand Crafted Cake shall in no circumstances whatsoever be liable to the purchaser in respect of any loss or damage whether suffered by the purchaser or by any customer of the purchaser and whether direct or indirect consequential or howsoever arising except where the parties to the transaction could have contemplated such a loss at the time of the contract.

5. Law A) If any part of these terms and conditions shall be found to be unlawful it shall not affect the validity or enforceability of the remainder of the conditions provided the contract is capable of continuing without such terms and conditions.

B) These terms shall be deemed to have been made in England and shall in all respects be governed by English Law except where the statutory rights of consumers within the European Union are otherwise protected within the law of the state or country of delivery.

C) In respect of consumer statutory rights within the European Union these are unaffected by these terms and conditions.

7. Consumer Rights
The terms and conditions listed for citizens of the European Union are determined by specific consumer legislation and the rights of the purchaser are governed by such consumer legislation. If there is any conflict between the Terms and Conditions of this Web Site and consumer legislation the rights of the consumer under the legislation will not be affected.

8. Methods of Payment
EU residents pay the VAT inclusive price (VAT at appropriate rate, currently 20%). Non-EU/exempt pays the VAT exclusive price.
Payment is only accepted by credit/debit card unless otherwise agreed with Hand crafted Cake. Visa, Mastercard, American Express, Switch and Delta cards are acceptable subject to individual credit/debit limits and the authorisation policy of the card issuing organisations We cannot accept any responsibility or liability in the event that a card payment fails or is refused.

9. Suitability of Goods or Services
We do not warrant the suitability of goods or services for a particular purpose other than that illustrated within product/service instructions specifications or guides and purchasers should check specifications size and suitability before ordering.

10. Security
Security on the transaction is protected by secure server process via STRIPE. Specific security information may be obtained by calling their customer support by viewing their website at www.stripe.com.
Customer Service and support is available by using the online contact form on this Site or by telephoning our Customer Support line on 01204 696204. The cost of any telephone calls shall be at the applicable rate of the Country of origin. No premium rate telephone charges are levied by this organisation nor do we receive any share of any telephone call charges. The telephone lines are open normally Monday to Friday between the hours of 9-00am and 4-45pm GMT or BST depending on the time of year.

Any redistribution or reproduction of part or all of the contents in any form is prohibited other than the following:
– You may print or download to a local hard disk extracts for your personal and non-commercial use only.
– You may copy the content to individual third parties for their personal use, but only if you acknowledge the website as the source of the material.

CELEBRATION CAKE TERMS AND CONDITIONS
THESE TERMS AND CONDITIONS DO NOT IN ANY WAY AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER. The content of the pages of this website is for your general information and use only and is subject to change.
Please take a few minutes to read through the Terms and Conditions as these form the basis of the contract. Further information can be provided on request.

DEPOSIT & PAYMENT POLICY
When placing an order for wedding cakes we require a minimum of a 50% deposit, this is a non-refundable and none-transferable deposit to secure the date you require and is also to cover the necessary time given to your order prior to your wedding date – this may include some of the following; administration costs, emails, phone calls, consultations, wedding cake samples etc. Final payment for wedding cakes is due no later than ONE MONTH before the wedding date. If the final payment is not received a reminder may be sent, if no further payment is made we will consider the order cancelled and the deposit lost.

For celebration cakes a minimum deposit of 50% is required (unless otherwise agreed). All deposits are non-refundable. Your deposit is included in the price of your celebration cake. If you pay for your celebration cake online, full payment is required at the checkout process. If the cake is cancelled, only 50% of your deposit MAY be refunded. (More details below).

FOOD ALLERGY DISCLAIMER
Hand Crafted Cake’s is NOT an allergy-free site. We cannot guarantee that our products are free from ingredients that may affect those with food allergies. At Hand Crafted Cake we recognise the seriousness of food allergies and we recommend that you contact us before you place an order to inform us of any food allergies that you or your party may have, we reserve the right to decline any orders for clients with serious food allergies. Hand Crafted Cake’s will not assume any liability for adverse reactions to our products.
The following ingredients are used in our kitchen:
Milk and other dairy products
Eggs
Nuts: peanuts, pecans, walnuts, almonds, cashews, coconut
Wheat and gluten
Please note that some food colourings may have an effect on behaviour in children.

DELIVERY POLICY
All delivery charges will be explained on our website at the checkout process, please note these are viable to change.

TRAVELLING WITH THE CAKE
DO NOT place the cake on a seat in the car, seats are slanted and can damage the cake. The cake should be placed either in the boot or the foot well of the car on a non-slip mat. Extra care should be taken when driving as some elements may be delicate. Hand Crafted Cake cannot take any responsibility for damage to cakes when collected and transported by their customers.

STORAGE
All cakes / cupcakes should be placed on a flat surface and stored at room temperature in the box provided. They should be kept out of direct sunlight. Freezing or refrigerating our cakes or cupcakes is not recommended (unless told to do so). Please note cupcakes should be consumed within 2 days and cakes within 5 days.

CHANGES TO YOUR ORDER
Hand Crafted Cake aims to meet your requirements and understands that sometimes situations occur which can result in you wanting to change your order. Please contact us as early as possible to ensure any changes can be actioned, generally 1 weeks’ notice is required for any changes and any changes may be subject to changes in cost depending on the design details. Please note a reduction in costs is only allowed up to a maximum of 10%.

CAKE STANDS / HOOP HIRE
Please note all hired items must be returned to Hand Crafted Cake directly within 5 days of the wedding, please do not leave any items at the venue unless otherwise agreed with us. Failure to return a cake stand to us within 5 days or in cases of loss or damage we will issue an invoice for the replacement cost, this is to be paid within 5 days. Cake stands and hoops if invoiced vary from £50 to £100.

NON-EDIBLE ITEMS
Most cakes contain small proportions of inedible items; it is the customers responsibility to ensure these are removed by your guests before consumption e.g. Support dowels in tiered cakes, ribbon, wires in sugar flowers, Swarovski crystals, flower picks & flower tape etc.

COLOURS AND DESIGN
You may wish to supply us with sample colours (i.e. ribbon / material). Whilst an exact match cannot be guaranteed we will endeavour to meet your requirement as far as possible. This also applies to food colourings and icings. We can only create your finished order from what we interpret from the wording of your order; therefore it is vital you check everything is correct. It may not be possible to create exact specifications when modelling food, however we will work with you, often using images to ensure you are happy with the design.

OUR PRODUCTS
Products made by Hand Crafted Cake’s are made by hand and accordingly there will be minor variations in appearance. All photos, illustrations and descriptions displayed on our page are for guidance purposes only.

PHOTOGRAPHY
On occasion we will photograph our cakes and we reserve the right to use any photographs for display or promotion without compensation to you.

CANCELLATION POLICY
For weddings if you cancel within 3 months of the date 50% of the full payment will be invoiced, cancellation within 1 month of the date 75% of the full payment will be invoiced. This is to cover monies lost as Hand Crafted Cake’s will have turned away other business for your order, it is very unlikely we could re-fill the date at such short notice. If you cancel your wedding cake within 1 week of your event full payment will be retained.

For all other celebration cakes, if the customer cancels their cake 1 week before, they will not receive their 50% deposit back as that is a non refundable and non transferable cost. If the customer cancels within 48 notice, the customer will not be entitled to any refund (to cover the costs for Hand Crafted Cake, for all the work/admin done).

Cancellation by Hand Crafted Cake: We shall not be liable for any failure to perform, where such failure or delay results from any circumstances outside our reasonable control including but not limited to any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of God, or from any industrial dispute or strike whatsoever. In the event of exceptional circumstances, such as serious illness, Hand Crafted Cake will give as much notice as possible if we are unable to fulfil your order. We will endeavour to find someone else who can produce your order and will refund you any monies already paid.

Postponements: In the event that you wish to postpone your wedding please let us know as soon as possible, your previous booking will be considered cancelled and will be subject to the cancellation policy above and a new booking will be placed for the new date. If you wish to re-book for a new date this will be subject to a further booking fee to secure the new date. New bookings will be subject to any price increases since the original booking was made. Any monies paid over the booking fee will be carried over to your new date.

COMPLAINTS
All cakes require a signature on delivery / collection, this indicates you are happy with the product received. If you are not happy please ensure you make this known when accepting your cake. This gives us the opportunity to correct any problems. We are not responsible for mistakes made by the customer i.e. incorrect / misspelled names or incorrect choice of cake. We always keep samples of our products for a reasonable time. In addition, we always take photographs of the cakes prior to delivery / collection.
Complaints are extremely rare at Hand Crafted Cake. Some complaints may require further investigation and an immediate refund may not always be possible. Cakes, or part of cakes and cupcakes, must be returned to us within 24 hours to ensure we are able to fairly assess the nature of the complaint. The cake must have been stored at the correct temperature and in the box we supplied, out of the sun and away from damp conditions or heat. If you are complaining for a refund you must return at least 75% of the uneaten product within 24 hours of delivery/collection.

We do not refund for customers that have simply changed their mind or if the cake has been damaged out of our care. If on delivery/collection the customer notices an error with the cake, Hand Crafted Cake reserves the right to amend/swap the cake and return it to the customer corrected. If the customer notices an error with the cake (wishes a refund/to cancel) and does not want the cake to be corrected, then the cancellation policy applies and the customer may not be eligible for a refund.
Please note icing may crack as it dries out which is out of our control and why we recommend you consume your cake as soon as it is cut. We do not accept complaints for not liking the taste of our products mainly because individual’s tastes are different. We can offer a tasting service for a small fee which allows you the opportunity to taste our products should you wish to do so prior to ordering.

ACCEPTANCE OF CAKE UPON COLLECTION/DELIVERY
The customer will be asked to sign a sheet that will state the following:
I confirm that this cake has been collected / delivered (delete as applicable) in good and undamaged condition. No responsibility can be taken by Hand Crafted Cake for any subsequent damage once the cake has been handed over to the customer or venue. Hand Crafted Cake will not be liable should the customer believe there are any problems with the cake once it has been accepted, this includes design, colour etc
